They apply only if the Customer is an undertaking (enterprise) within the meaning of the Belgian Code of Economic Law (WER). These Terms do not apply to consumers. Consequently, statutory consumer rights, such as the right of withdrawal, do not apply to the Service.<\/p><p><strong>1.2.<\/strong>\u00a0The Service is provided by Rankshift BV (&#8220;Rankshift&#8221;, &#8220;Provider&#8221;, &#8220;we&#8221;, or &#8220;us&#8221;), a company incorporated under Belgian law. The Provider and the Customer (&#8220;you&#8221;) agree that these Terms shall exclusively govern the contractual relationship. Rankshift is designed to help companies assess and analyze their visibility in Large Language Models (LLMs). The exact features of our Service are described on our website.<\/p><p><strong>2.2. Service Modifications:<\/strong>\u00a0Rankshift may make reasonable changes to the Service (e.g., to improve performance or to comply with legislation), provided such changes do not eliminate core features of the Service. We will inform you of any material changes in a timely manner.<\/p><p><strong>2.3. Third-Party Components:<\/strong>\u00a0If our Service relies on third-party providers or data sources, the availability of those external services is outside of Rankshift&#8217;s control. If a third party ceases to provide a necessary component, we will inform you and will strive to find a suitable alternative.<\/p><p><strong>2.4. Interruptions:<\/strong>\u00a0Rankshift relies on LLM technology to generate data. While we will use commercially reasonable efforts to ensure the smooth operation of the Service, we do not warrant that the Service will be completely error-free or uninterrupted. This constitutes a best-efforts obligation (obligation of means), not an obligation of result.<\/p><p><strong>2.5. Prohibited Use:<\/strong>\u00a0You are not permitted to decompile, reverse engineer, or otherwise misuse the Service. By providing Customer Data, you grant Rankshift a license to process and use that data only to the extent necessary to provide the Service and to fulfill our contractual obligations. Invoicing and Payment:<\/strong>\u00a0Invoices are issued according to the agreed-upon cycle (e.g., monthly or annually in advance). Payments are due within 14 days of the invoice date. In case of late payment, default interest in accordance with the Belgian Act on Combating Late Payment in Commercial Transactions, as well as a lump-sum compensation, shall be due by operation of law and without prior notice of default. Termination for Convenience:<\/strong>\u00a0A monthly subscription can be terminated by either party, effective at the end of the current billing cycle. An annual subscription can be terminated with thirty (30) days&#8217; notice before the end of the annual cycle. Entire Agreement:<\/strong>\u00a0These Terms constitute the entire agreement between the parties and supersede all prior oral or written agreements. Severability:<\/strong>\u00a0If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
